ModeFlowers.com ("the site") is the trading name of Mode Excel Limited ("the company" or "we"), company number 6897860, registered in the UK. The website ModeFlowers.com is wholy owned and operated by Mode Excel Limited.
The following details the Terms and Conditions ("Terms and Conditions") to which you, the consumer, are consenting to when using services or ordering products either through the company, the ModeFlowers.com website ("The website") or by telephoning one of our sales representatives. General
1.1 Mode Excel Ltd's policy is to always source the freshest possible flowers at the best possible prices for use within our products. Whilst every care is taken to ensure that the products we make and deliver are as accurate to those depicted in our imagery, seasonal fluctuations can and sometimes do occur. We always endeavour to meet your expectations by delivery a product that reporesents, to the best of our ability, what we market on ModeFlowers.com. Typically we like to dispatch young and very fresh flowers that are still in bud, this is where the flowers have yet to open. Whilst this can lead to some confusion, with a very small percentage of our customers, as to product representation it will preserve and prolong the shelf life of the flowers and increase your enjoyment of them.
1.2 Right of substitution. All the products we sell are subject to availability which can and does vary from season to season. In the rare event that we experience supply difficulties we reserve the right to substitute, without notice, a product of equivalent or greater value. Whilst this is our right, our sales team will make endeavour to make every effort to contact you and alert you of any supply difficulties we may be currently experiencing. During this dialog we will explain what we propose to do for you and discuss any of your preferences. Please also note that any foliage and sundries that we use whilst making your product (including vases) may be substituted without any prior notice.
1.3 In the very rare event that we are unable to fulfil all or part of your order we will, of course, offer you a full and complete refund in the same manner to which the payment was made, for example if you paid via vouchers, we will credit the same value in vouchers back onto your account. Our obligation to you for a refund is within 30 days of receiving the order instruction from you.
1.4 In the event of any questions or queries you may have, you are free to contact us via email or by telephone to one of our sales representatives who will be happy to assist you. Many of the commonly asked questions are published and may address any issues you experiencing or questions you may want to ask.
Delivery
Mode Excel Ltd will make every possible step to ensure that data we collect from you is full, complete and accurate. To avoid any possible delays in the delivery of your product, please enter all contact details including full address, including postcode for both for yourself and your recipient together with your daytime, evening and mobile phone numbers and a contact telephone number for the recipient. Ultimately the accuracy of the information entered on the website is your responsibility.
Upon order completion we will send you a confirmation email summarising your order. Please check that the information we hold is both accurate and valid. Mode Excel Ltd will not be contractually bound by a contract with you until we have issued you with a confirmation email.
To qualify for free delivery products selected must total £24.99 including discounts and promotions. Where the total order value falls below this value, and free delivery is selected, the difference will be made up to the mimimum order value.
Unless specified otherwise, our standard delivery is for next working day, netween normal business hours - 8am - 6pm. A full and comprehensive range of delivery options will be presented to you through the ordering process, by default you will be presented with a pre-selected standard delivery option.
Whilst we offer a range of delivery times and options, these are guidelines only. Whilst every care will be taken to adhere to your selected delivery times, occasionally, due to unforseen circumstances beyond our control, we may have to alter delivery times, we will aim to keep these alterations as close to your selected delivery time as possible.
Time sensitive orders to be delivered outside the UK such as the Channel Islands and Republic of Ireland, will be fulfilled to the best of our ability, however you acknowlege that delivery as specified on the order cannot be guaranteed and we are under no obligation to refund any delivery costs when the specified delivery dates and times cannot be fulfilled.
Our normal days of business are Monday - Saturday. Usually we are closed for business on Sundays and public holidays however do offer some exceptions such as Mother's Day. If you require a non-standard delivery time and date, please contact our customer services team, either by phone or email and we will endeavour to accommodate you where ever possible.
Some products will not be eligable for delivery in certain locals in mainland UK. We will make you fully aware of these caveats during the checkout process. Before placing your order, please review all the delivery cut-off times and prices.
When ordering through Mode Excel Ltd you are agreeing to the the fact that sometimes we will be delivering through one of our third party distributors or associate florists.
Deliveries to certain locations

Deliveries to Hotels, hospitals, funeral parlours, ships, holiday parks, business parks and offices, we may need to leave the products with a person who is not the intended recipient. In such circumstances we will leave the delivery with an authorative person from the organisation / location we are delivering to. This will constitue fulfillment of the order delivery.
Deliveries to hospitals

For orders where the recipients are in a Hospital it is very important that you check the delivery details you sumbit to us very carefully to ensure the information is correct, up to date and that the recipient is allowed to receive flowers. Sometimes pateints are moved around and it can be problematic for us to locate them and can result in our failure to deliver. Whilst we endeavour to fulfil our instructions to the letter, due to health and safety regualtions or due to the recuperative sate of patiends sometimes our delivery people are unable to make the delivery in person. By ordering through us you are agreeing to the fact that sometimes we may have to leave the orders with authorative people who are not the intended recipient, such as with ward sisters, porters, receptionists and post room masters. If the information we receive is out of date, or the hospital has a no gift delivery policy then we are unable to make any refund or arrange a courtesy re-delivery of the goods.
Delivery to Funeral Parlours
============================
In the case of delivery to a funeral direcors, Please ensure that you supply us with the name of the deceased and the name and number of the funeral director and if possible, the date of the funeral. This will ensure that the flowers will arrive as intended and also to help the funeral directors deal with the delivery. Without a recipients name the funeral directors may not accept delivery and in these circumstances we regreat that we are unable to make a refund for non-delivered goods or offer alternative delivery or re-delivery options. We recommend sending sympathy flowers a few days prior to the date of the funeral to ensure they can be catered for by the funeral directors.
Delivery Process
================
During the check out process we offer you the ability to specify how the order gets delivered, by completing the delivery instructions section. Your delivery instructions will be our first priority for fulfilling delivery committment. Occasionally we are unable to fulfil your instructions to the letter due to factors outside of our control (for example, the recipient no longer has a porch etc.). When these situations occur we will follow our standard method of delivery which is to attempt to leave the delivery with a neighbour. If we are unable to leave the delivery with a neighbour, or to find a suitably secure location to leave the delivery, we will leave a card at the recipients address. If we fail to make delivery following our standard delivery practise we will contact you and let you know. We are not obliged to refund any delivery costs or are liable for any associated costs incurred to a recipient.
Occasionally we one of our third party distribution partners to fulfil order delivery on our behalf. Whilst their processes are similar to ours, our partners usually require orders to be signed for by the recipient. Delivery instructions given at order entry will be followed to their best ability. Following a failed delivery, our distribution partners may also leave a card notifying the recipient that they called and were unable to deliver the order. Delivery is usually attempted again although we cannot guarantee this is always the case.
Cancellation Policy

Once we have accepted an order, you are free to cancel your order at any time up until the order goes into a processing state. Once in the processing state order cancellation is entirely at our discression and usually only in exceptional circumstances. Please telephone our customer services department and speak to our friendly stadd to see what we can do for you.
Amendments Policy
=================
We want you to be happy with your purchase and as such want to allow you to make amendments to any orders that you place with us. Once your order has been submitted on the website, you will need to call or email our sales representatives as soon as possible. Whilst we are as flexible as we can be, we do need to allow ourselves enough time to make the necessary amendments to your order, such as delivery address, times etc. For this to occur, we need to hear about any amendments before 12pm, noon, on the day prior to the delivery date you originally specified. We will need to be notified straight away for any amendments required for orders placed for same day delivery or those orders that are placed after 12pm noon for next business day delivery. Wilst we will do all that we can to make changes for you, cannot guarantee to do so if the order has progressed too far in our dispatch chain. Our friendly staff will do all we can to accommodate your wishes. Our amendments policy is different for our busy periods.

Our incredibly busy periods are Mother's Day, Valentine's Day and the Christmas period. During these periods we will require 48 hours notice to make any amendments to your orders. Whilst it is in our ethos to to whatever we can to assist you with making changes to your order we cannot guarantee that we will be able to make any alterations when received with less than 48 hours notice - we will of course endeavour to do what ever we can for you. Please call a cutomer services representative or email us.
Damaged Goods
=============
Although we do our very best to ensure the safe transit of your products, on very rare occasions, products arrive at their destination damaged. Should you or the recipient ever experience this rare occurrence, please contact our sales representatives so they may action one of the following for you:
1. Re-delivery of the product at the next available and convenient date. We regret that for smaller items, such as vases etc. we will not be able to re-deliver them, but instead will offer a full refund to the value of the damaged item
2. Offer a full refund (Please note the refund will be partial and specific to the product damaged in transit.)
Mode Excel Ltd is constantly striding to improve the service we offer our customers. If you are unfortunate enought to be the recipient or purchaser of products that arrive damaged, we may ask you for photographic representation of the problem. This will help us to determine the root cause of the problem and for us to action accordingly either with our packaging techniques or our courier or partner distributor.
Product Care

100% Satisfaction Guarantee

Our 100% satisfaction guarantee is applicable to situations and circumstances which are which are within our complete control, for instance we will not be held responsible for delivery to incorrect addresses due to user input error, delivery venues which will not allow deliveries to be made, such as is sometimes the case in Hospitals and funeral parlours or delivery refusals by recipient individuals.
System Errors
=============
We take great care with the development and testing of or eCommerce platform to ensure we give you the best customer service we can, but very occasionally we experience system errors which are largely out of our control. When such situations arise, we are under no obligaiton or are contractually bound to accept orders which may potentially have been entered in an erroneous state, through no fault of the user. In such circumstances and where monies have been received we will offer a full refund and will do so within 30 days.

1.3 Credit card details
Mode Excel Limited allows and offers our customers a range of convenient well known and popular payment fascilites. Whilst some of these payment methods allow our customers to enter their credit carde detail it is the policy of Mode Excel Limited never to store or hold any credit card information. Credit card information we take on our website from our customers is securely encrypted and passed on to our payment partners for processing. We will only pass sufficuent information to our partners to fascilitate the processing and delivery of any order you place with us.
1.4 Mode Excel Limited will never knowingly partner with any vendor that shares, leases, distributes or sells any of our customers data.
1.5 Mode Excel Limited is not responsible for the content of external internet sites. You are advised to read the privacy policy of external sites before disclosing any personal information.

A "cookie" is a small data text file that is placed in your browser and allows Mode Excel Limited to recognize you each time you visit this site(customisation etc). Cookies themselves do not contain any personal information, and Mode Excel Limited does not use cookies to collect personal information. Resolution Policy

Very occasionally things go wrong, whilst every care is taken to ensure this doesn't occur, we are aware we are only human and therefore the first to admit that things can go wrong! The below details our resolution policy should this occur.
1. Where we have failed fulfill your order we will offer a full refund
2. In the event we have made a late delivery, we will refund the delivery charge
3. If we send an incorrect product, please return the product to us and we will resend the correct product.
4. If we have failed to deliver your product, we will offer a full refund.
5. Damaged goods, please refer to our damaged goods section.
Abusive Behaviour
Our staff are dedicated and enthusiatic and have the right to work is a threat free environment. As such we will not tolerate and aggressive or abusive behaviour towards our staff and reserve the right to cancel orders and refund monies placed pertaining to any abusive individuals. We also reserve the right to block any further use of our systems and services in the future.
Busy Periods
Mode Excel Ltd is a responsible retailer and takes great care and due diligence to adhere to it's social responsibilities. Mode Excel Ltd. is registered to distribute alcohol throughtout the UK. By ordering alcoholic products through our websites, or by teleponing one of our representatives you are agreeing that you, or the recipient of alcoholic products are over Eighteen (18) years of age. If any of our staff believe that a minor is attempting to purchase alcohol from ourselves, either by using someone else's payment details or by persuading an adult to purchase on their behalf, then we reserve the unreserved rights to refuse and we do not have to offer an explanation. We regret that we are unable to distribute Champagne products to the United States or America.
